The New Patriotic Party (NPP) is in an uproar, vehemently contesting the Tamale High Court's decision to nullify the 2024 parliamentary election results in the Kpandai Constituency. This ruling has ignited a firestorm of controversy, with the NPP's National Organiser, Henry Nana Boakye, leading the charge and labeling the court's actions as a dangerous assault on Ghana's democratic principles.
At a press conference held in Accra, and visibly somber in black attire, Nana Boakye minced no words, expressing the party's deep concern over what he termed a blatant disregard for justice. The court's verdict, delivered on November 24, 2025, mandated a rerun of the election, a move that the NPP believes poses a significant threat to the stability of the electoral process and the integrity of the judicial system in Ghana.
According to Nana Boakye, the High Court's ruling seems to have overlooked some fundamental mathematical realities. He pointed out that the NPP's parliamentary candidate had secured a decisive victory, leading by a substantial 3,734 votes. He emphasized that this margin was insurmountable, even if all the irregularities alleged by the petitioners were proven true.
He further highlighted that the petitioners themselves acknowledged that their claims were limited to results from only 41 polling stations, involving approximately 500 votes. He questioned how such a small number of votes could possibly overturn a lead of 3,734, arguing that the judgment defied both mathematical logic and common sense.
But here's where it gets controversial... Nana Boakye didn't stop there; he accused the judge of simply reciting the legal framework for evaluating election petitions without actually applying it correctly, calling the conduct "judicial fraud." He argued that both Ghana's election regulations and established Supreme Court precedents clearly state that an election should not be nullified if the proven irregularities cannot change the final outcome.
He insisted that the High Court completely disregarded this crucial principle, bypassing the requirement to assess the "affected results" and instead directly annulling the entire election based on allegations of irregularities.
Nana Boakye described the ruling as a reckless deviation from established electoral law, warning that such judgments could encourage losing candidates to abuse the judicial process to disrupt democratic outcomes. He stressed that the verdict jeopardizes the stability of Ghana's election adjudication system and could potentially cause widespread chaos if upheld.
He clarified that while the NPP holds the judiciary in high regard, this respect does not extend to accepting what he sees as a severe miscarriage of justice. He maintained that true respect for judicial institutions involves speaking out against violations of the law and disregard for constitutional principles.
He vowed that the party would challenge the ruling through every available legal avenue, referencing Section 20 of PNDC Law 284, which outlines the standards for determining election petitions.
